Trade Marks



Corporate identity and brand names or logos can be the most valuable marketing tools which a company possesses. Quite simply, trade marks sell products and services. Registration of a trade mark protects this business asset, giving the proprietor the legal remedy to prevent others from using the same or similar mark and protecting the legitimate service industry or manufacturing base. The definition of a 'trade mark' in the Malaysia has been widened recently to include 'signs' such as the shape or colour of a container, a jingle, or even a smell.

Local Restaurant Specialising in Malay Food Protects its Name

Realising that it had built up substantial goodwill through its loyal customer base who came from afart to satisfy their hunger for well cooked Malay cuisine, a local restaurant wanted to protect its simple sounding name from being used by others.

Little did the owners realise that this could be done by trademarking their name and Adastra handheld them throughout the application process right up to the grant stage. With their mark registered and with Adastra monitoring the market for potential copycats, the restaurant owners felt secure and confident that they would be able to continue serving up good food without having to worry about a competitor coming up with a similar name and taking their business away.

A major exhibitor who successfully organized an annual exhibition of home interior décor was beginning to attract the attention of competitors who were keen to ride on their success and were organizing similar exhibitions using a similar sounding name in their promotional materials which confused members of the public.
